Welcome to Imagine Meditation (the "App"). The App is operated by Imagine Meditation ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms of Use (the "Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms
By using the App, you agree to comply with and be bound by these Terms. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App following any changes constitutes your acceptance of the revised Terms.

2. Eligibility
The App is intended for users who are at least 18 years old. By using the App, you represent and warrant that you are at least 18 years of age or have the consent of a parent or guardian.

3. Subscriptions
3.1 Subscription Plans
The App offers auto-renewable subscription plans that provide access to premium content and features. Subscription plans are available on a monthly or yearly basis, with both plans offering the same features and content access.

3.2 Billing
Your subscription will automatically renew at the end of each billing cycle unless you cancel it at least 24 hours before the end of the current period. Your payment method will be charged within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal in your account settings.

3.3 Free Trial
We offer a 7-day free trial for certain subscription plans. If you do not cancel your subscription before the end of the trial period, you will be charged the subscription fee on the first day after the trial ends.
3.4 Cancellation
You may cancel your subscription at any time. After cancellation, you will continue to have access to the premium features until the end of the current billing period.
3.5 Refund Policy
We do not offer refunds for any subscriptions or services provided through the App.
4. Privacy
Your use of the App is also governed by our [Privacy Policy](https://www.imaginemeditationapp.com/privacy), which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

5. User Conduct
You agree not to use the App for any unlawful or prohibited purpose. You agree not to:
- Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.
- Attempt to gain unauthorized access to any part of the App, other users' accounts, or any related systems or networks.
- Use any automated means, including bots, scripts, or crawlers, to access the App for any purpose.
6. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, and software, are the exclusive property of Imagine Meditation and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the App without our express written permission.
7. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

8. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

9. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms or fail to make timely payments. Upon termination, your right to use the App will cease immediately.

10. Changes to Terms
We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms within the App. Your continued use of the App following the posting of any changes constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the App.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
